Winston Cup Museum owner responds to motion filed in contempt

Winston Cup Museum owner Will Spencer said he complied with all the terms of the agreement when the lawsuit was settled.

WINSTON-SALEM, N.C. — The owner of the Winston Cup Museum Will Spencer responded to a claim in a lengthy ongoing legal battle. 

You might remember when the Guilford County company ITG Brands sued the museum for copyright infringement earlier in 2023. 

After both parties settled the manner, ITG Brands said the museum didn't hold up its end of the agreement. Some of the things in the agreement required the museum to stop selling branded merchandise manufactured after 2003 that contained Winston, Winston Cup, Winston Cup Series, or any other ITG mark and branding. It also required the museum to remove past social media posts about ITG or the litigation. All of the things required in the agreement, Spencer said they've done. 

ITG filed a motion to the judge asking to hold the Winston Cup Museum owner in contempt.

Spencer responded Tuesday, asking the judge to dismiss the complaint — saying the complaint has no basis.

Over the weekend, the museum closed for good.

Now, the owner plans to launch a digital platform for the museum at a later date.
