Winston Cup contempt claim dismissed, court docs say

The court denied ITG Brands' claim of the Winston Cup owner being in contempt of their agreement.

WINSTON-SALEM, N.C. — A claim made at the end of 2023 against the Winston Cup museum owner, accusing him of contempt of their agreement, has been denied. 

On Dec. 8, 2023,  ITG Brands accused the Winston Cup owner Will Spencer of violating the terms of their agreement and wanted the court to hold him in civil and criminal contempt for violating this prohibition. 

After settling in court in November 2023, the museum was required to stop selling branded merchandise manufactured after 2003 that contained Winston, Winston Cup, Winston Cup Series, or any other ITG mark and branding. It also required the museum to remove past social media posts about ITG or the litigation. 

All of the things required in the agreement, Spencer said they've done. 

On Feb. 6, the court ruled there was insufficient evidence to move forward with the motion to hold Winston Cup in contempt.
