Former President Trump will appear on NC primary ballots. Here's why

A complaint was filed trying to remove Trump from the North Carolina primary ballot.

COLORADO, USA — Former President Donald Trump can not appear on the presidential primary ballot in Colorado. The state Supreme Court ruled Tuesday that his role in the January 6th attacks bars him from the White House. But he will be included on North Carolina's primary ballot for Republicans. 

The Colorado justices cited a clause in the 14th Amendment that had never been used before. The ruling overturns a lower court's decision and will likely be settled in the U.S. Supreme Court. 

"We've never really fleshed a lot of this issue out," CBS News Election Law Contributor David Becker said. "What we know is it doesn't mean that someone has to be convicted of sedition or insurrection. The term engaged in insurrection is used in the 14th amendment, not convicted, not found by a court and we're going to take that language as it is in the 14th amendment."

Trump's legal team promised to file an appeal and called the decision undemocratic. 

The State of Colorado says any higher court ruling must come before January 5th, when it starts printing primary ballots.

In the meantime, election officials in North Carolina opted against weighing in on Trump's candidacy. Someone filed a complaint, trying to remove him from the North Carolina primary ballot. 

The filing cited the same clause in the 14th Amendment of the Constitution. 

The NC State Board of Elections voted 4-1 to dismiss the complaint, saying it was not sure whether it had the authority to decide on the issue. 

The board on Tuesday approved the list of candidates that will go on North Carolina primary ballots, which included former president Trump. The primary election in North Carolina is on March 5.
