Alamance County, NC -- Burlington Police arrested a man wanted in connection to a cold-case in Ohio.
They arrested Marvin Lee Smith, Jr., 51, on a fugitive from justice warrant at his job at Wal-Mart on March 28.
D-N-A evidence linked him to the sexual assault of a murdered fifteen year old. Someone murdered 15-year old Jessica Lyn Keen in 1991.
Marvin Smith was convicted of rape, kidnapping and robbery in an unrelated case around the same time. He served nearly nine years in prison and during that time he had to submit a D-N-A sample, according to WBNS-TV in Columbus, Ohio.
Only recently were investigators able to match that sample to one found in the Keen case. They tracked Smith to Burlington, where he has lived for several years.
"Even if he did do it, he'd still be welcome at my home. He could still come visit us," said Sandra Martin, a friend and neighbor.
"We know Marvin for what he is now. But what he is now, he's a rapist and a killer of a child, that's what he is to me. I really don't want no use for him, if he did this," said Rhonda White, who lived next door to Smith for the last year. She said Smith lived with her and her husband for four years.
According to court documents, Smith was out on bond for another crime when Keen was murdered. He's now being held at the Alamance County jail. His extradition hearing is April 30.
Once he's back in Ohio, he faces charges of unlawful sexual conduct with a minor. That's what links him toKeen, so he could also be charged with her murder.
Friends and police say Smith had several DWI charges andcitations for not having a license while in North Carolina.
