DAVIDSON COUNTY, N.C. — Tuesday marks the second day of a sentencing hearing in the 2015 murder of a man in Davidson County.
On Monday, Molly Corbett pleaded no contest to voluntary manslaughter, and her father, Tom Martens pleaded guilty to the same charge in the murder of Jason Corbett back in 2015.
This week, Corbett and Martens are having their sentencing hearing where a judge will decide exactly what their sentence will be.
In this hearing on Tuesday, witnesses were called in, testimonies were read, and evidence was brought before the judge.
Two murder weapons were used in the death of Jason Corbett — a baseball bat and a brick paver.
Molly Corbett and her father, Martens arrived at the Davidson County courthouse to kick off day two of the hearing.
The jury trial that was supposed to take place in Forsyth County next week will not happen due to these pleas accepted by the judge.
The state played a 90-minute video of Tom Martens. He is talking to investigators just hours after the killing in 2015.
You hear Martens saying, "I hit him. I hit him with the baseball bat," and "I was scared to death he was going to kill her."
Here's a little background on how we got here.
Jason Corbett, an Irish businessman, and Molly Corbett got married and moved from Ireland to Winston-Salem in 2011.
Molly Corbett was Jason Corbett's nanny to his two children, Jack and Sara after his first wife died from an asthma attack.
In August 2015, Molly Corbett's parents came into town to visit the family.
Late that evening, Tom Martens, Molly Corbett's father woke up to the couple arguing.
He claims Jason was strangling Molly Corbett and claims that Jason and Molly argued constantly in their relationship.
Martens then hit Jason Corbett, in the head, with a metal baseball bat.
The two struggled, Molly Corbett then hit Jason Corbett with a brick paver left on the nightstand.
In 2017, both Molly Corbett and Martens were sentenced to 25 years in prison for the death of Jason Corbett.
In 2021, the state supreme court overturned their convictions citing errors in the trial.
Since the beginning, Molly Corbett and Martens have claimed self-defense in Jason Corbett's death.
In court this week, the defense says that Jason Corbett has a history of violent behavior and even questions if his first wife's passing was from natural causes or if Jason had something to do with it.
The defense also said that Jason Corbett had a blood alcohol level of .02 the night of his murder.
In court, the defense and the state are going back and forth with the evidence they have.
A diagram of the home was shown Tuesday to get a better understanding of where everyone was, at the time of the murder that night.
A picture was also shown of Jason Corbett's hand, which had blonde hairs in it after he was killed.
The defense is holding strong to the fact that they think this was self-defense, while the state thinks the complete opposite, saying the multiple blows to Jason Corbett's head after he was unconscious were excessive.
The family of Jason Corbett flew from Ireland to be in court this week which included Jason's now 16-year-old daughter Sara and 18-year-old son Jack.
A decision on sentencing is expected after this hearing wraps up in a few days.
