Formula maker PBM Nutritionals, LLC is settling a class action lawsuit, according to the Kroll Settlement Administration. They said the lawsuit claimed the company deceptively packaged and labeled certain formula products. It alleges that the packaging said the formulas could make a specific number of bottles when following directors, but that the products did not make that amount.
The Kroll Settlement Administration PBM Nutritionals denied the allegations but settled the case to avoid more time in court that would remove resources from its business.
HERE'S THE IMPORTANT INFORMATION, PARENTS:
If you bought any of the following formulas between January 1, 2017 and July 21, 2022, you're eligible to submit a claim:

- Little Journey
- Wesley Farms
- Burt’s Bees Baby
- Berkley Jensen
- Parent’s Choice
- Earth’s Best Organic
- Comforts
- Up & Up
- Babies “R” Us
- Member’s Mark
- Bobbie Baby
The settlement provides up to $2,000,000 to pay valid claims:
- People with proof of purchase can get $2/unit up to a total of $30/household
- People without proof of purchase can get $2/unit up to $10/household
- You cannot submit a claim under both categories
- Claims have to be made by 11:59 p.m. on November 30, 2022

In addition to the $2,000,000 paid out in the settlement, the Kroll Settlement Administration said PBM Nutritionals agreed to change its labeling practices. If you bought the formulas listed within the lawsuit time period and do not file a claim, you give up your rights to sue PBM Nutritionals in the future.
